Content Use Agreement

We love your content and we are excited you are considering allowing Brunswick Corporation and its brands (further referred in this agreement as Brunswick) to share it with others. We want to make sure you know how we’d like to use it. If you choose not to give us permission, that’s alright too - no further action is needed.

By responding affirmatively, either through use of an indicated hashtag (examples that may include but are not limited to #YesBrunswick, #YesLund, #agree,  etc.), phrase, or statement or if/when provided, checking the appropriate box on a web page or form, or upload a photo, video or other content to one of our forms or campaigns, you agree to the following terms & conditions:

  • By letting Brunswick use my content, I give permission to use everything in it—my image, video, GIF, text, voice, testimonial, music and so on (referred to in this agreement as Content). I am confirming that I own everything in the Content (including music, if applicable), I have the right to let Brunswick use the Content regarding any people or things shown, and nothing in my Content violates anyone else’s intellectual property rights. I continue to own the Content, but I am granting Brunswick permission to use it in any way discussed in this agreement.
  • I hereby agree and consent to unrestricted, unlimited, non-exclusive, non-revocable use of the photographs, video, text, likes or other Content that I created. This constitutes a non-exclusive, royalty-free, worldwide, perpetual, transferable, irrevocable, license to use, reproduce, modify, publish, transfer, create derivative works from, distribute, and display or publish in various formats, including but not limited to news stories, online posts, websites, emails, TV, movies, print material, paid media, or advertising in any form and in any media. If new content or modifications are made by us to your Content, I agree that I will not see or have approval of the final product. I will not be compensated for the Content I am allowing Brunswick to use as part of this agreement. I understand that while Brunswick will make efforts to give credit and link back to my social media (where applicable), the use of my Content is not dependent on credit being given.
  • I hereby irrevocably waive all legal rights related to all claims including, but not limited to, copyright, trademark or other intellectual property claims or invasion of privacy. Additionally, I agree to defend, indemnify and hold harmless Brunswick, its employees, affiliates, licensees and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from any breach of any of these Terms and Conditions or any other claims of liability from Brunswick’s use of the Content.
  • I confirm I am at least 18 years old. I further agree and attest that I am the legal guardian or natural parent of any minor children/wards depicted in any content.

I understand that the Content may include personal information, and that Brunswick may use that information as described in its Privacy Policy (https://www.brunswick.com/privacy-policy) Personal information could be transferred, stored, or processed in the United States, which might have different data protection rules than the jurisdiction in which I live.

If any part of this agreement is found to be invalid, that part will be considered null and void, but the rest of the agreement will stay in effect. This agreement is governed by Illinois law.
